Absolute scenes inside the UK Supreme Court today as judges ruled that the legal definition of a woman is based on biological sex.
There were hugs and tears from campaigners and supporters of For Women Scotland as they emerged from the supreme court singing “women’s rights are human rights”.
The Supreme Court ruling, delivered by Lord Hodge and on which all five judges agreed, concluded that the meaning of the terms “sex”, “man” and “woman” in the Equality Act 2010 refer to “biological sex”. It added that any other interpretation would make the Act “incoherent and impracticable”.
The landmark ruling comes after a long-running legal battle between the Scottish government and For Women Scotland. The Scottish government had argued that transgender people with a gender recognition certificate (GRC) are entitled to sex-based protections, while For Women Scotland argued they only apply to people that are born female.
As per the BBC, the judges were sure to point out that the ruling was not a triumph for one side over the other (even though it kind of is), and the law would still give transgender people protection from discrimination.
Massive respect to For Women Scotland for taking on the Scottish government on this and actually winning. It’s pretty amazing that something so obvious had to go to court in the first place, but the important thing is that justice has been done.
Hopefully this means a fairer and more logic-based based approach to the gender identity issue in the future, while also making life easier and safer for both biological women and transgender women.
