Chelsea striker Sam Kerr has been cleared of racial harassment after calling a police officer “f***ing stupid and white”, after she’d been arrested for vomiting inside a taxi, smashing the back window and refusing to pay for the damage.

Here’s the moment she was filmed on bodycam racially harassing the police officer (or apparently not – according to Kingston Crown Court):

Sam Kerr did not deny using the words “stupid and white” but denied it amounted to a racial offence, and the jury at Kingston Crown Court cleared her in relation to an incident. 31-year-old Kerr claimed she had been “antagonised” by officers after she was taken to a police station by the taxi driver following their dispute:

“I believed [PC Stephen Lovell] was using his power and privilege over me because he was accusing me of being something I’m not.

“I was trying to express that due to the power and privilege they had, they would never have to understand what we had just gone through and the fear we were having for our lives.”

After being cleared of any wrongdoing, Sam Kerr released this statement:

“While I apologise for expressing myself poorly on what was a traumatic evening, I have always maintained that I did not intend to insult or harm anyone and I am thankful that the jury unanimously agreed.

“I am fully focused on getting back on to the pitch and look forward to an exciting year ahead for me and my family.”

For what it’s worth, PC Stephen Lovell claimed that Sam Kerr’s words left him “shocked, upset and humiliated”, but I guess the jury didn’t deem them harsh enough to be categorised as racial harassment. Naturally, people on social media are now up in arms about how the verdict would have been different if a white person had called someone, let alone a police officer, “stupid and brown/black”.

Does this verdict now set a legal precedent where you can call anyone “f***ing stupid and (colour of your choice)”? Well, probably not because a jury found her not guilty, rather than a judge. In fact word is that the judge wasn’t overly impressed with the jury’s decision, saying in relation to legal costs afterwards:  “Her own behaviour contributed significantly to the bringing of this allegation.”

Ultimately it seems like taking the whole thing to court was a big waste of time of money. Still, I guess it’s a Win for anyone who believes that mean words should not be punished by law.
